Housing Supply Shortfall Applications

Sworders has had great success in achieving consent for residential schemes on Greenfield sites within development limits, with Local Plan allocations and through the five year supply shortfall.

We have had particular success with schemes in sensitive locations where the balance must be struck between maximising value and maximising the chances of success. We find that the approach of consulting with the council and local residents prior to submission and through the application process can secure consent without the cost and uncertainty of going to appeal.

Local Planning Authorities have the responsibility to boost significantly the supply of housing, provide for the full, objectively assessed need for housing and demonstrate a five year supply of such housing land. Where Local Authorities are under performing and are unable to demonstrate that they have sufficient land available to provide the necessary housing for their population, this presents an opportunity to submit a speculative planning application for housing to make up this shortfall in supply ahead/outside of the Local Plan process.

We have maximised this opportunity for landowners through identifying clients’ land in sustainable locations (for example, on the settlement edge) and progressing housing schemes with considerable success and have achieved consents for both small and large schemes.

If the district is unable to demonstrate a five year supply or is relying on out-of-date evidence of housing need, there may be a short-term opportunity to secure consent. The five year supply is a constantly moving target, so the window of opportunity does not remain open in the longer term.
